1. Definitions

Terms such as "Personal Data", "Data Principal", "Data Fiduciary", "Data Processor", "Processing" and "Consent" carry the meanings assigned under the DPDP Act. For this policy, the Company is the Data Fiduciary and you are the Data Principal. The DPDP Act applies one protection framework to all Personal Data; should the Central Government notify categories requiring additional safeguards, we will comply.

2. What we collect

Information you provide directly: name, work email, company, phone number and message contents when you use our contact form, book a call, request documentation or correspond with us; billing and agreement details for customers.

Automatically collected technical information: IP address, device and browser type, operating system, language, pages viewed, session data and usage patterns, collected through standard website analytics (Google Analytics).

Transactions: payments for engagements are processed by third-party payment processors. We do NOT collect or store full card numbers, CVV or bank account credentials; we receive confirmation of successful transactions and maintain invoicing records.

3. Personal data and our data services

Our data services collect publicly available business data - prices, listings, availability, rankings and reviews in aggregate. Collections are designed to exclude personal data wherever the use case permits, and we do not sell personal data. Customer obligations around personal data in deliverables are set out in the Acceptable Use Policy.

4. Purposes of processing

We process Personal Data to: respond to enquiries and deliver the services; create and manage customer accounts and credentials; communicate service updates and support responses; send marketing communications only with separate opt-in consent; detect and prevent fraud, abuse and security threats; conduct analytics and improve the Service; and comply with applicable law. We will not process Personal Data for other purposes without notifying you and obtaining consent where required. We do not sell, rent or trade Personal Data.

5. Legal basis and consent

We process Personal Data on the basis of your consent under Section 6 of the DPDP Act, or for legitimate uses permitted without consent under Section 7 - including data you voluntarily provide for a purpose you would reasonably expect, compliance with law or court orders, and responding to emergencies. Consent is obtained by clear affirmative action (submitting a form, opting in) with notice of what is collected and why. You may withdraw consent at any time, with the same ease it was given, by writing to shakir@scrapeguys.com; withdrawal does not affect prior lawful processing.

6. Cookies and analytics

The website uses analytics cookies (Google Analytics) to understand aggregate usage; these services are governed by their own policies (see https://policies.google.com/privacy). Your browser settings can block or clear cookies, and the site works without them. We do not currently respond to Do-Not-Track signals.

7. Sharing and disclosure

We share Personal Data only with service providers acting as Data Processors on our behalf - such as hosting, analytics, scheduling, communications and payment providers - under contractual confidentiality and security obligations. We may disclose Personal Data without consent where permitted by law: to comply with law, regulation, court order or legal process; to enforce legal rights; to protect the rights, property or safety of the Company, our users or the public; or in connection with a merger, acquisition or asset sale with notice where feasible.

8. Data retention

In line with Section 8(7) of the DPDP Act, we retain Personal Data only as long as necessary: enquiry and support correspondence - 3 years; customer account and agreement records - duration of the engagement plus 3 years (limitation period); transaction and invoicing records - 8 years (Companies Act, GST and income-tax requirements); website analytics - per Google Analytics retention settings (14 months by default), aggregated thereafter; consent records - duration of the relationship plus 5 years. On expiry or valid erasure request, data is securely deleted or anonymised, subject to legal retention obligations; anonymised data may be retained for analytics.

9. Security and breach notification

In accordance with Section 8(4) of the DPDP Act we implement reasonable security safeguards: encryption in transit (TLS), access controls, security assessments and incident response procedures, and we require our processors to do the same. No system is completely secure and we cannot guarantee absolute security.

In the event of a Personal Data Breach we will notify the Data Protection Board of India and affected Data Principals as required under Section 8(6), including the nature of the breach, likely consequences, measures taken and a contact for further information.

10. Cross-border transfers

Personal Data may be transferred to and processed in countries outside India by our service providers, subject to Section 16 of the DPDP Act and any government notifications restricting transfers. Where data is transferred abroad we implement contractual safeguards and processing agreements, and we will comply with any future transfer restrictions notified by the Central Government.

11. Your rights

Under Chapter III of the DPDP Act you have the right to: access a summary of your Personal Data and processing activities (Section 11); correction, completion, updating and erasure (Section 12); readily available grievance redressal (Section 13); nominate another individual to exercise your rights in case of death or incapacity (Section 14); and withdraw consent at any time. To exercise any right, contact the Grievance Officer below; we will verify your identity and respond within the prescribed period. If unsatisfied, you may complain to the Data Protection Board of India.

12. Children

The Service is intended for business users aged eighteen (18) or above; we do not knowingly collect Personal Data of children as defined under Section 9 of the DPDP Act. Continued use after changes constitutes acceptance except where specific consent is required.

15. Governing law

This policy is governed by the laws of India, including the DPDP Act, 2023. Disputes are subject to the exclusive jurisdiction of the courts of Maharashtra, India.
